General Provisions
1.1 This Privacy Policy is prepared in accordance with the requirements of the Federal Law.
1.2. KC&Trees’s most important purpose and condition for carrying out its activities is to respect the rights and freedoms of individuals and citizens in the processing of their personal data, including the protection of their rights to privacy and to personal and family secrets.
1.3 This KC&Trees Privacy Policy (hereinafter the “Policy”) applies to all information that KC&Trees may receive about website visitors.
Basic concepts used in the Policy
2.1 Automated processing of personal data – processing of personal data by means of computer technology;
2.2 Blocking of personal data – temporary suspension of processing of personal data (unless the processing is necessary to clarify personal data)
2.3 Website means a set of graphic and informational materials, as well as computer programs and databases, ensuring their availability on the Internet at a network address.
2.4 Personal Data Information System – an aggregate of personal data contained in databases of personal data and information technologies and technical means ensuring their processing;
2.5 Impersonalization of personal data – actions, as a result of which it is impossible to determine, without using additional information, whether the personal data belongs to a particular User or another subject of personal data;
2.6 Processing of personal data – any action (operation) or set of actions (operations) performed with or without the use of automation means with personal data, including collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of personal data;
2.7. KC&Trees of personal data – a state body, municipal body, legal entity or individual, independently or together with other persons, organizing and (or) carrying out processing of personal data, as well as determining the purpose of processing of personal data, composition of personal data subject to processing, actions (operations) performed with personal data;
2.8. Personal Data – any information relating directly or indirectly to a particular or definable KC&Trees User.
2.9 User – any visitor to KC&Trees.
2.10. Provision of personal data – actions aimed at the disclosure of personal data to a certain person or a certain circle of persons;
2.11. Dissemination of personal data – any actions aimed at disclosure of personal data to an indefinite circle of persons or familiarization with personal data to an unlimited circle of persons, including disclosure of personal data in mass media, placement in information and telecommunication networks or providing access to personal data by any other means;
2.12. Cross-border transfer of personal data – transfer of personal data to the territory of a foreign state to a foreign state authority, a foreign individual or a foreign legal entity;
2.13. Destruction of personal data – any action, as a result of which personal data is destroyed irretrievably with impossibility to further restore the content of personal data in the information system of personal data and (or) destroyed material media of personal data.
KC&Trees may process the following personal data of users
3.1 Surname, first name, patronymic;
3.2 E-mail address;
3.3. telephone numbers.
3.4. Any other information provided by the User to KC&Trees which is suitable for the purposes of processing of personal data (the list above may be shortened or extended, depending on the particular case and the purposes of processing).
Purposes of processing of personal data
4.1 The purpose of processing of the User’s personal data is informing the User by sending e-mails, text messages, telephone calls, clarifying details of the order; transferring to the User, making inquiries, receiving from the User information necessary for execution of the order, providing the conditions for acceptance and execution of the order, formation and sending of payment documents, formation and maintenance of the client base.
4.2 KC&Trees also has the right to send the User notices of new products and services, special offers and various events.
4.3 The anonymized User Data collected via Internet statistical services is used to collect information on the actions of Users on the Web site, to improve the quality of the site and its contents.
Legal Basis for Processing of Personal Data
5.1 KC&Trees shall process the personal data of the User only if the User fills out and/or sends in the relevant forms by itself. By completing the relevant forms and/or sending its personal data to KC&Trees, the User expresses its consent to this Policy.
5.2. KC&Trees processes anonymized data of the User if this is permitted in the settings of the User’s browser (cookie storage and use of JavaScript technology enabled).
Procedure of collecting, storing, transferring and other processing of personal data
6.1 Processing of personal data by KC&Trees shall be carried out in the following ways:
- non-automated processing of personal data;
- automated processing of personal data with or without transmission of received information via information and telecommunications networks;
- mixed processing of personal data.
6.2 List of actions performed by KC&Trees with personal data: collection, systematization, accumulation, storage, clarification (update, change), use, distribution (including transfer), depersonalization, blocking, destruction, as well as any other actions in accordance with applicable law.
6.3 The security of personal data processed by KC&Trees shall be ensured by implementing legal, organizational and technical measures necessary to comply fully with the requirements of current legislation in the field of protection of personal data.
6.4 KC&Trees shall ensure the security of personal data and take measures to exclude access to personal data by unauthorized persons.
6.5 The personal data of the User shall never, under no circumstances, be disclosed to any third party, except in the case of compliance with current legislation.
6.6 Personal data shall be stored in a form that makes it possible to identify the subject of personal data (other than data collected in anonymized form) for a period no longer than required by the purposes of personal data processing, or for any other period, if another period is prescribed by law. A condition for termination of personal data processing may be the achievement of the objectives of personal data processing, expiration of the consent period or withdrawal of consent to process personal data by the subject of personal data, as well as the detection of unlawful processing of personal data. Personal data shall be stored by KC&Trees by placing it in the information system of personal data and (or) on tangible media of personal data, ensuring conditions that ensure the safety of personal data and exclude access to personal data by unauthorized persons.
Cross-border transfer of personal data
7.1 Before transborder transfer of personal data, KC&Trees is obliged to ensure that the foreign country to whose territory personal data transfer is planned to be carried out, provides reliable protection of personal data subjects’ rights.
7.2 The transborder transfer of personal data to foreign countries, which do not meet the above requirements, may be carried out only if the consent in writing of the personal data subject for the transborder transfer of his/her personal data and / or performance of the contract, to which the subject of personal data is a party, is available.
Final Provisions
This document will reflect any changes to KC&Trees’ policy for processing personal data of Users. The Policy shall be valid indefinitely until replaced by a new version. The new version of the Policy shall take effect upon posting on the Website, unless otherwise provided by the new version of the Policy.
